Terms of Engagement

1. Nature of Services

Medrixa Sphere operates as a healthcare recruitment consultancy. Our role is to facilitate the identification, screening, and introduction of suitable medical professionals (including doctors, consultants, and healthcare staff) to hospitals, clinics, diagnostic centers, and other healthcare organizations (“Employers”).

Medrixa Sphere does not function as a job portal, staffing agency selling databases, or employment exchange.

2. Scope of Engagement

By submitting information through our website, email, WhatsApp, or any other communication channel:

• Hospitals / Employers acknowledge that they are seeking recruitment support.
• Doctors / Candidates acknowledge that they are sharing their professional details for potential career opportunities.

This engagement allows Medrixa Sphere to:

• Collect and review profiles and requirements
• Conduct preliminary screening
• Share relevant profiles with mutual consent
• Coordinate interviews and communication

3. No Guarantee of Employment or Hiring

Medrixa Sphere does not guarantee:

• Employment for any candidate
• Selection, interview, or offer from any hospital
• Fulfilment of any specific salary, role, or location expectation

Final hiring decisions, employment terms, compensation, duties, and joining timelines are solely decided between the hospital and the candidate.

4. Consultant Role & Limitation

Medrixa Sphere:

• Acts only as a facilitator and advisor
• Does not act as an employer, agent, or legal representative of either party
• Is not responsible for post-joining performance, conduct, retention, or separation

All employment contracts are executed directly between the hospital and the doctor.

5. Confidentiality & Data Use

• All information shared by doctors and hospitals is treated as confidential.
• Candidate profiles are shared with hospitals only after screening and relevance assessment.
• Data is not sold, rented, or publicly published.
• Information is used strictly for recruitment and placement purposes.
• Both parties agree not to misuse, distribute, or disclose shared information without written consent.

6. Fees & Commercial Terms

• Recruitment fees, if applicable, are not charged at the form submission stage.
• Commercial terms, including fees, replacement clauses, and timelines, are discussed and agreed separately via email, engagement letter, or MoU.
• Fees (where applicable) are typically success-based and payable only upon confirmed joining, unless otherwise agreed in writing.

7. Independent Verification

Hospitals are advised to: Independently verify credentials, registrations, licenses, experience, and references of candidates before issuing offers.

Doctors are advised to: Independently verify hospital credentials, work conditions, facilities, and employment terms before accepting offers.

Medrixa Sphere is not liable for inaccuracies provided by either party.

8. No Exclusivity Unless Agreed

Submission of a requirement or profile does not imply exclusivity unless expressly agreed in writing. Both hospitals and candidates are free to engage with other consultants or opportunities.

9. Limitation of Liability

Medrixa Sphere shall not be held liable for:

• Any loss, damage, dispute, or claim arising from employment decisions
• Misrepresentation by either party
• Post-joining disputes, resignations, terminations, or contractual issues

Our liability, if any, is limited strictly to the scope of recruitment facilitation.

10. Termination of Engagement

Either party may discontinue engagement with Medrixa Sphere at any time by written communication. However, confidentiality obligations shall survive termination.

11. Governing Law & Jurisdiction

These Terms of Engagement shall be governed by and interpreted in accordance with the laws of India. Any disputes shall be subject to the jurisdiction of the competent courts in Punjab, India, unless otherwise agreed in writing.

12. Acceptance of Terms

By submitting information, profiles, or requirements to Medrixa Sphere through any medium, both hospitals and candidates confirm that they have read, understood, and agreed to these Terms of Engagement.
